1. Acceptance of Terms
By creating an account or using Publish Owl, you agree to these Terms of Service, our Privacy Policy, and any additional terms that may apply. If you do not agree to these terms, do not use our service.
2. Description of Service
Publish Owl is an AI-powered content automation platform that enables users to create, manage, and publish articles using various AI providers. The service includes:
- Multi-step content generation workflows
- Integration with CMS platforms (WordPress, Ghost, Webflow, etc.)
- Template-based programmatic SEO capabilities
- Image generation and template editing
- Scheduling and automation features
3. Bring Your Own Keys (BYOK) and API Cost Responsibility
Publish Owl operates on a "Bring Your Own Keys" model. You are solely responsible for all API costs incurred through your use of the service. This means:
- You must provide your own API keys for AI providers (OpenAI, Anthropic, Google, etc.) and image generation services (GPT Image, Flux, Stable Diffusion, etc.)
- All costs for content generation, image generation, web search, and the Owlbert AI assistant are billed directly to you by the respective providers
- Publish Owl does not provide AI credits, subsidize API costs, or have any visibility into your provider invoices
- Publish Owl will not refund, reimburse, or compensate you for any API costs, regardless of whether you are satisfied with the generated output
- You are responsible for setting appropriate spending limits and monitoring usage on your provider accounts
- Costs may vary significantly based on your prompts, model selection, content length, and usage volume
- You must comply with each AI provider's terms of service and acceptable use policies
Before running bulk operations, we strongly recommend:
- Testing with a single article first to verify output quality and estimate costs
- Setting spending limits on your AI provider accounts
- Understanding the pricing of each model you select
- Reviewing your workflow configuration and prompts carefully
By clicking "I understand I'm responsible for API costs" before running jobs, you acknowledge that you accept full financial responsibility for all charges incurred from that operation.
4. User Responsibilities
You agree to:
- Provide accurate account information
- Maintain the security of your account credentials and API keys
- Not use the service for any illegal or unauthorized purpose
- Not generate content that violates any laws or third-party rights
- Verify that you have the right to use any images, media, or other third-party assets you select through the service before publishing
- Not attempt to circumvent any security measures
- Not resell or redistribute the service without authorization
- Comply with all applicable laws and regulations
5. AI-Generated Content Quality and Your Review Responsibility
Publish Owl is a tool that facilitates AI content generation. We do not generate, review, edit, or approve any content. You are solely responsible for all content created using the service.
AI-generated content may contain:
- Factual errors and inaccuracies — AI models can generate incorrect information presented as fact
- Hallucinations — AI may fabricate citations, statistics, quotes, or other information that does not exist
- Outdated information — AI models have knowledge cutoff dates and may not reflect current events or changes
- Biased or inappropriate content — Output may reflect biases present in training data
- Plagiarism or copyright issues — AI may reproduce copyrighted text or closely paraphrase existing works
- Grammatical or stylistic issues — Output quality varies and may not meet your standards
- SEO or formatting problems — Generated content may not be optimized for your specific needs
You must review all generated content before publishing. By clicking "I understand I'm responsible for reviewing the content" before running jobs, you acknowledge that:
- You will review all generated content for accuracy, quality, and appropriateness before publishing
- You are responsible for fact-checking all claims, statistics, and citations
- You are responsible for ensuring content does not infringe on third-party rights
- You accept all consequences of publishing the generated content, including legal liability
- Publish Owl is not liable for any damages arising from content you publish
Publish Owl makes no warranties or guarantees about the quality, accuracy, originality, or suitability of any generated content. We provide tools; the output depends on AI models operated by third parties, your prompts, and your configuration. Dissatisfaction with output quality is not grounds for refunds of subscription fees or API costs.
6. Content Ownership
You retain ownership of all content you create using Publish Owl. However:
- You are responsible for ensuring your content complies with applicable laws
- AI-generated content may be subject to the terms of the AI providers used
- You grant us a limited license to store and process your content as necessary to provide the service
- We do not claim ownership of your content or use it for any purpose other than providing the service
7. Images and Media
Publish Owl provides tools to search for and insert images from various sources, including stock photo providers (Pexels, Pixabay, Unsplash), Creative Commons aggregators (Openverse, Wikimedia Commons), web image search (via Google Images), and AI image generation services.
You are solely responsible for ensuring you have the legal right to use any images you select and publish. Specifically:
- Stock photos (Pexels, Pixabay, Unsplash) are provided under their respective platform licenses, which generally permit free use with or without attribution. Review each platform's license terms.
- Creative Commons images (Openverse, Wikimedia Commons) are provided under specific CC licenses that may require attribution, restrict commercial use, or restrict modifications. License details are displayed alongside each image. You must comply with the specific license terms.
- Web image search results (Google Images) may include copyrighted material. When the Creative Commons filter is enabled, results are filtered to images that Google has identified as CC-licensed based on page metadata, but this is not a guarantee of license accuracy. You should verify the license on the source page before using any image.
- AI-generated images are subject to the terms of the AI provider used to generate them (e.g., OpenAI, Stability AI, etc.).
Publish Owl does not verify, warrant, or guarantee the licensing status of any image. We provide search tools and display license information where available, but the responsibility for verifying and complying with image licenses rests entirely with you. Publish Owl is not liable for any copyright infringement claims arising from your use of images obtained through the service.
8. Prohibited Content
You may not use Publish Owl to generate content that:
- Is illegal, harmful, or promotes illegal activities
- Infringes on intellectual property rights
- Contains malware, spam, or phishing attempts
- Is defamatory, harassing, or discriminatory
- Violates the terms of service of integrated AI providers
- Misrepresents AI-generated content as human-written where disclosure is required
9. Subscription and Payment
Subscription terms are outlined in our Subscription Policy. By subscribing to a paid plan, you agree to:
- Pay the applicable fees as described at checkout
- Provide accurate billing information
- Accept automatic renewal unless you cancel before the renewal date
Refunds are handled according to our Refund Policy.
10. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue any part of the service at any time. We are not liable for any downtime, data loss, or service interruptions.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUBLISH OWL AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, punitive, or consequential damages
- Loss of profits, revenue, data, or business opportunities
- Any costs incurred from third-party API providers, including but not limited to OpenAI, Anthropic, Google, Perplexity, xAI, Anchor Browser, OpenRouter, or any image generation services
- Any content generated by AI models, including errors, inaccuracies, hallucinations, or any other defects
- Any consequences of publishing AI-generated content, including legal claims, reputational damage, or SEO penalties
- Actions taken by CMS platforms, hosting providers, or other integrated services
- Service interruptions, downtime, or data loss
- Unauthorized access to your account or API keys
- Your failure to review content before publishing
SPECIFICALLY, PUBLISH OWL SHALL NOT BE LIABLE FOR:
- API charges you incur, regardless of whether you are satisfied with the output
- Content that contains factual errors, even if you publish it without review
- Any financial, legal, or reputational harm resulting from published content
- Model behavior, including unexpected outputs or changes in AI model performance
Our total liability for any claim shall not exceed the amount you paid us for Publish Owl subscription fees (excluding third-party API costs) in the 12 months preceding the claim.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- The service will meet your specific requirements
- AI-generated content will be accurate, complete, or suitable for any purpose
- The service will be uninterrupted or error-free
- Any defects will be corrected
13. Indemnification
You agree to indemnify and hold harmless Publish Owl from any claims, damages, or expenses arising from your use of the service, your content, or your violation of these terms.
14. Termination
We may terminate or suspend your account at any time for violation of these terms or for any other reason at our discretion. Upon termination:
- Your access to the service will be revoked
- Your data may be deleted after a reasonable retention period
- You remain responsible for any outstanding fees
15. Governing Law
These terms are governed by the laws of the State of Illinois, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Illinois.
16. Changes to Terms
We may modify these terms at any time. We will notify users of significant changes via email or through the service. Continued use after changes constitutes acceptance of the new terms.
